Employment Claimants

Focused, professional support for workplace disputes.

Special Counsel assists employees, workers, and senior executives in bringing and resolving Employment Tribunal claims.

Our work is grounded in legal analysis, procedural discipline, and realistic assessment of risk and outcome.

We support claimants at all stages of the dispute process - from early advice through to hearings and settlement - and we expect matters we assist with to be engaged with seriously.

Employment Tribunal Claims

We assist claimants in bringing and conducting Employment Tribunal proceedings, including:

  • analysis of claims and available remedies,

  • drafting and submission of ET1 claim forms,

  • preparation of pleadings, witness evidence, and schedules of loss,

  • representation at preliminary and final hearings where appropriate,

  • ongoing case management and procedural support.

Claims we assist with are reviewed by experienced lawyers and are advanced on a structured and evidence-based basis.

2

Early Advice & Merits Assessment

Before a claim is issued, we provide clear advice on:

  • prospects of success,

  • evidential requirements,

  • procedural risks and deadlines,

  • strategic options, including settlement.

We do not encourage unmeritorious or speculative claims.

Our role is to ensure that claims which proceed are properly framed and pursued.

3

Pre-Action Strategy & Settlement

Many employment disputes can and should be resolved before a final hearing.

Special Counsel assists with:

  • pre-action correspondence and engagement,

  • ACAS Early Conciliation strategy,

  • settlement negotiations and terms,

  • realistic valuation of claims and risk.

Where resolution is possible, we pursue it efficiently.

Where it is not, we prepare matters accordingly.

4

Representation & Support

Employment Tribunal representation and advocacy may be provided by solicitors employed within our practice, operating within a non-authorised entity.

We also support claimants who choose to act in person by:

  • explaining procedural steps and tribunal expectations,

  • assisting with document preparation and presentation,

  • ensuring compliance with rules and deadlines.

Our aim is to reduce imbalance and ensure claims are presented clearly, coherently, and properly.

5

Who We Act For

We assist claimants across a wide range of employment disputes, including:

  • unfair and constructive dismissal,

  • discrimination and harassment,

  • whistleblowing and detriment claims,

  • wage, bonus, and contractual disputes,

  • redundancy and consultation failures,

  • senior executive and complex workplace disputes.

Where claims intersect with other areas of law, we coordinate specialist input or introduce appropriate panel firms.
